Terms of Service

By commissioning me you agree to my TOS, wether you read them or not.1. General TermsAll drawings may or will include a sign/signature that you may not remove.I might record the drawing process and post it online. I have the right to use, post, and show commissioned artwork.Prices are subject to change based on demand, changes, and complexity.I have the right to reject any order for any reason at any time.I reserve the right to cancel and refund as needed at any time for any reason.Commissioned art is for personal use only and should not be used commercially (for money/profit).2. PaymentMain currency is USD, but I can accept whatever currency that gets through my payment options.I currently only accept the following payment methods: Paypal, Venmo, Patreon, Kofi, and Discord Nitro.Unconventional payment like character designs etc… may be accepted on a case by case basis, if I really want/like it.Commissions can be paid either 100% upfront or split 50% upfront and 50% after sketch approval.Sketch commissions must be paid 100% upfront.I will not work / continue working on the commission until payment is made.I will either send you an invoice (email required) for PayPal / Venmo or payment will be through Kofi (non-refundable) or sent to me directly through discord nitro (non-refundable).Do not send me any payment before I have agreed to give you a slot and requested you to send me the payment.3. Process and DeliveryI will notify you when I have started on your commission and you, therefore, then can only get a max of a 50% refund of total cost provided you paid 100% of the commission price.Sketch commissions are non-refundable unless I have not worked on them.While working on your commissions I will check in with you to make sure I make it just right (be sure to be available).The amount of reviews depends on the complexity of work.Revisions that exceed time paid to work on the commission will come at a additional fee.The time it takes to finish your commission will vary from the day of to a few months, depending on factors such as health, the complexity of commissioned piece, other work, and school.Typically Illustration art takes 1-3 weeks minimum.If you need the illustration prior to at least 3 weeks, a rush fee will apply.There are no deadlines for animated commissions as animation is a long process, but you will be updated as consistently as possible on the progress.If anything comes up that will slow the progress of the initially estimated delivery time I will let you know asap.Once the piece is finished you will receive the full resolution file.
Note: there is no physical product.Please mention if you want to print said artwork prior to starting said commission.4. Revisions / References
You will get 3 rounds of changes on the commissioned piece included in the price.Sketch commissions may have less rounds of changes and animation commissions may have more rounds of changes.A fee will be added if you want something changed on the final drawing - unless a misunderstanding from my side had been made.If you wish for me to change something in the drawing that has been previously approved, I will charge you a fee to change it.The amount of extra charge depends on the change you want me to make and is usually based on hourly wage.If your references are unclear to start with, the changes / time spent researching will come at an extra charge.A design fee will apply If there is no actual reference images for the character/subject and would like me to draw from a description or collage of images.5. Copyright / UsageI as the artist, claim the rights to the produced drawing, not the buyer.Thus I retain all copyrights over commissioned artwork.Therefore I am allowed to use the copyright artwork to:Promote myself with it everywhere.
Publish books with it (artbooks, etc..).Display / post it wherever I want (website, social media, portfolio, publications, youtube, prints, graphics, etc..).Reserve full rights to the images use/distribution.I will notClaim any intellectual property that is not mine in the commissioned art work.Financially profit further from commissioned artwork unless agreed upon or the customer breaks any of the terms.The commissioner is allowed to:Use the commissioned piece for any personal use that does not violate my terms of service and/or my rights / ownership of the copyright.Unless agreed otherwise, upload it on all your social media profiles, forums, etc.Print the artwork and claim wherever characters / ideas that are yours as your own, but not the artwork itself.Use the artwork to promote yourself.Use the artwork on their youtube channel and in monetized videos as long as the artwork itself is not the main subject for the earnings.The commissioner is not allowed to:Remove / alter / change any of the signs and signatures in the commissioned piece.Show any of my NSFW art to un-consenting people including, but not limited to all minors (people under 18 years old).Use commissioned art commercially (for money)(Including any and all use for NFTs).Use my art to harass/bully/manipulate.Use my art to inspire/promote harm of others.The following is considered copyright infringement:Reproducing/using the copyright artwork commercially - meaning making money off of it in any way (example: use in an NFT, reselling, redistributing, making prints to sell, etc).Claiming the artwork as your own.Removing / Altering my signature / watermark from the artwork.Altering the artwork without my consent. (Coloring sketches, drawing over, etc…)6. Customer SatisfactionChanges in terms may be discussed prior to the start of the commission / paying for the piece.If there are any issues please tell me right away and we can try to find a solution together.7. Refund CancellationThe buyer is not allowed a total refund once I start working on the commission.If for any reason I am unable to start your commission or you cancel before I start it, you will receive a full refund if possible.If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself.If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all before mentioned rights to the commissioned piece and I will have the full right to profit further from it in any way.I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you.Furthermore, you will be blacklisted from commissioning me again.If the buyer breaks any of the above points / terms of service they lose all the before mentioned rights to the artwork commissioned by me, the artist, and I will have the right to profit further from your commissioned artwork in any way I see fit.
